Recently, the China National Intellectual Property Administration (CNIPA) issued Examination Decision No. 589758 regarding a request for invalidation filed by Shenzhen Comen Medical Instruments Co., Ltd. ("Petitioner") against a utility model patent titled "A Portable Ultrasound Device" held by a certain Shenzhen company ("Patentee"), declaring the involved patent rights entirely invalid.
The Kangrui team assisted Comen Medical in achieving the final victory in this patent game within the medical device field.
In this invalidation case, the Kangrui legal team, relying on rich experience and professional search capabilities, represented Comen Medical in filing the request for patent invalidation and submitted supplementary observations and a large amount of supplementary evidence within one month. This forced the patentee to make substantial amendments to the claims and use additional technical features from the original dependent claims as the primary points of distinction for defense, in hopes of maintaining the amended claims.
Faced with the patentee's response strategy, the Kangrui legal team swiftly adjusted the main direction of attack and reorganized the presentation of evidence to precisely concentrate the invalidity attack on the disputed technical features. Ultimately, the CNIPA supported our arguments and declared the amended claims entirely invalid.
Throughout the handling of this case, the Kangrui legal team consistently upheld a rigorous and professional practice attitude, fully invested professional resources, and maintained efficient and close collaboration with the client, ultimately successfully obtaining full support from the CNIPA and achieving an overall victory in the case.
The victory in this case not only effectively broke the patent barriers in the relevant product field but also provided a practical example of reference value for fair competition within the industry.
